Ranchi: Sources in the power corridor have confirmed that the government in gearing up to introduce a proposal for Sarna Code in the coming session of Jharkhand Legislative Assembly. The step is being taken keeping in consideration the upcoming central elections, sources confirmed.
However, the neither mother organisation Rasthriya Swyamsewak Sangh nor the political organisation of Bharatiya Janta Party seems to be standing by this thought.
Vanvashi Kalyan Kendra, a sister orginazation of RSS, has infact reached out the government to cease the facility of tribals from those who have got converted. “There are people who have got converted into Christians. They take dual benefit of being a tribal as well as minority. We have met the Chief Minister and have requested him to take action into the matter,” Sunil Kumar Singh, state office in-charge of VKK told NW.
The demand of VKK comes in light of a order passed by Kerela High Court which says therefore, are of the opinion that although as a broad proposition of law it cannot be accepted that merely by change of religion person ceases to be a member of scheduled tribe, but the question as to whether he ceases to be a member thereof or not must be determined by the appropriate court as such a question would depend upon the fact of each case. In such a situation, it has to be established that a person who has embraced another religion is still suffering from social disability and also following the customs and tradition of the community, which he earlier belonged to.
Elaborating the demands Singh said that the court has cleared that the tradition must be carried. “The tradition of marriage, for example, has changed for them. When it says about social disabilities it means stigma like ‘untouchability’ which in not there in any religion,” he added. He said the Chief Minister has taken the matter seriously and has asked the advocate general to look in the matter.
Meanwhile, BJP also seems to be not standing by the proposal, if true. “The issue of Sarna Dharm Code is principally wrong,” Pradeep Varma, state Vice-president of BJP said. He said that the matter is a concern of Centre and not of state.
“We need to understand that the tribals of Jharkhand call themselves Sarna, for Arunachal they have a different name. So for the 104 million tribals in India we will have to create around 50 codes, and that is impractical,” Verma added.
